POP UP CLUB LLC AGREEMENT & LIABILITY RELEASE

Throughout this form, the terms “we”, “us” and “our” refer to Pop Up Club 808 LLC.

‘Renter’ refers to any person or persons, company, business, organization, and or group, hiring from Pop Up Club 808 LLC.

The maximum number of people allowed inside our tents at any one time is as follows:

20 x 20 Black Tent – 30 people MAX If you have any furniture inside, this can alter the pax numbers. Pop Up Club 808 LLC will not be held responsible for any damage to equipment or furniture that is not rented from us.

Terms and conditions of rental:

A security deposit of 25% will be collected at time of rental.
Absolutely NO paint, sprays, or other sticky substances are allowed in the Inflatable Tent. Failure to follow these guidelines will result in the imposing of an additional cleaning fee and possible forfeiture of security deposit if there is damage.
Do not consume any food inside if the tent.
Drinks may be consumed inside the tent but please be careful of HOT drinks.
You may have equipment, decorations, furniture and balloons inside the tent but please No using pins and please keep sharp objects away from tent.
No open flames, cooking, fireworks, or smoking inside or near the Doing so may result in the melting of the material which can cause serious damage to the tent and put everyone at risk. Doing so will result in the forfeit of the security deposit and possible additional charges based on damage.

Anyone with head, back, neck, or any muscular-skeletal injuries or disabilities, pregnant women, children under 3 years of age, and others who may be susceptible to injury from falls and bumps MUST be supervised at all times around Inflatable Tent and any other equipment rented from us.
If the inflatable begins to lose air, make your way to the exit at once. You will need to check that the blower is connected to the tent hole.
If setup is outside, the Inflatable Tents MUST be always staked to the ground securely to prevent tipping or injury. Do not use it if winds exceed 20mph – The inflatable tent can flip over in high If high winds exist, exit the bounce house immediately and turn off the blower.
We cannot operate the Inflatable tent when raining or if the ground is wet. Risk of serious injury due to slipping hazards and electric shock from the blower if wet conditions exist.
Children’s safety depends on you. Your personal supervision is absolutely needed.
We will go through safety checks with you to make sure you understand the hazards that may arise while the tent is in your possession.
We will arrive 1 hour prior to rental to set up. The area where the tent is going must be free of hazards above or around the tent. The tent cannot be set up near power lines, construction sites, and any sharp or heated objects that may cause damage to the tent. If you supply misleading information regarding where the tent setup will be, we reserve the right to cancel. If canceled this way, you will be charged the normal 10% cancellation fee and lose your security deposit.
The blower of the tent is to be grounded, and in a safe place where rocks, debris or light loose items cannot be sucked into the blower. This can cause damage to the If set up is inside, please make sure this is portioned off so no one knocks the blower over.
The surface of where the tent is going must NOT be on a hill or any other area that we see unsafe. If we feel there may be a risk to your safety as well as others, we reserve the right to cancel.
As the renter of any of our Inflatable Night Clubs, the safety of all who encounter the inflatables or parts thereof is YOUR responsibility.
The renter acquires any permits that may be required to operate the equipment and hereby indemnifies Pop Up Club 808 LLC from any penalties or other obligations incurred due to the Renter’s failure to obtain or comply with any such permits.
No leaning, kicking, punching, or any willful damage to our tent or any Doing so will result in added charges and forfeit of security deposit
If the blower stops working, please ensure all users exit the inflatable tents at Make sure the blower tube or deflation tube has not come undone or something has not blown onto and is obstructing the blower. If it overheats, or loses power, switch the blower off at the mains, wait 1 or 2 minutes and then switch it back on again. If it does not re-start, inform us straight away.

OVERNIGHT RENTAL OF TENT – PLEASE READ:

Overnight rental is considered from 12 hours to a maximum of 16 hours rental max. WE DO NOT ALLOW ANY RENTAL THAT EXCEEDS 16 HOURS.
We will arrive between 4-7pm to set up, go over safety checks, and inspect the tent with you.
When it is nearing the end of your rental time, be sure to leave the inflatable fully inflated until we will arrive. We will inspect the tent to make sure there is no visible damage.
Once rental time is over, we will inspect inside the tent and anything else that belongs to Pop Up Club 808 LLC and make sure there is no damage.
When we collect our items and tents, the renter agrees that they will be there, in person, when we collect the tent so we may have access to the property to unplug our cords and collect any other gear inside.
If there is alcohol consumption, PLEASE DRINK RESPONSIBLY INSIDE AND AROUND OUR INFLATABLE NIGHT CLUBS. This is to reduce the risk of injury to others and reduce damage to our inflatable tents and any items belonging to Pop Up Club 808 LLC. We will not be held liable for any injuries caused from our Inflatable night clubs if patrons are intoxicated and misuse our inflatable night clubs at any time.
Please make sure guests at the property where we are collecting our items refrain from interfering with the setup, delivery, and pack down of our items.
If you live in an area with a Home Owners Association (HOA), be sure to adhere to any noise ordnances they have in place. We are NOT responsible for any HOA or local law enforcement citations.
If at any time our team feels threatened, harassed, abused, or discriminated against in any way, shape, or form, our team will exit the property and call 911 and wait for local police to arrive so we can collect our items safely. This will also put the renter at risk of a lifetime ban to not ever be able to rental from Pop Up Club 808 LLC.

ELECTRICITY:

Our inflatable party tents can be powered by a standard electricity source. If your set-up area is further than 50 ft from the closest power source, you will need to rent a generator yourself. This will need to be ready on site when we arrive for setup.

WEATHER:

We reserve the right to cancel any reservations due to severe or deterioration of The electrical blower is also not designed for wet weather.
Our tents are drizzle proof only – they are not weather proof! Automatic cancellations will occur if bad weather (rain and windy) persists on the day of your event if its outside.
- So, what happens to my booking if needing to cancel due to bad weather?
- We can reschedule your booking or offer you credit, or give you a refund minus a 10% administrative fee.
- We will notify you at least 12 hours before your event if the weather is meant to decline.

LIABILITY:

This rental equipment has been received in good condition and will be returned in the same condition (ordinary wear and tear accepted)
The renter assumes all responsibility for injuries to persons or damages to property and agrees to release and hold Pop Up Club 808 LLC harmless for all claims, of whatsoever nature, arising out of use of the rental equipment while in his/her custody. In the event that the release and hold harmless as contained herein is held unenforceable for any reason, the renter herby agrees to a limit on any damages claimed by Customer to the total paid to Pop Up Club 808 LLC for the rental.
Customer agrees not to loan, sublet or otherwise depose of equipment or use it at any other location.
The customer agrees to pay in full the replacement cost, including labor, for all damages to rental equipment.
If the equipment is lost, stolen, or damaged beyond repair the renter agrees the security deposit will be forfeited and will be invoiced any other amount (not to exceed $5,000.00) that will be payable to Pop Up Club 808 LLC.
THERE ARE NO WARRANTIES OF MERCHANTABILITY OR FITNESS EITHER EXPRESSED OR IMPLIED.

CANCELLATIONS:

In the event you need to cancel, within 48 hours, we can offer you credit, or give you a refund minus a 10% administrative fee.
If your cancellation is due to one of the safety issues above or less than 48 hours notices, we give you a refund minus a 10% administrative fee and loss of your security deposit.

The person/s or organization renting our Tents and any other items belonging to Pop Up Club 808 LLC will be held responsible and liable for any and all damage or injury occurring for any reason whatsoever. I have read the above agreement and fully understand and accept the conditions above. I am aware that while in my care I am fully responsible for the inflatable and will pay for any loss or damages that may occur.
